1. Agreement to Terms

By accessing cloudplusmarketing.com or purchasing any product or service from CloudPlus Marketing, you agree to be bound by these Terms of Service. If you do not agree, do not use our service.

2. What We Provide

Prism Website Visibility Check is a local business digital presence audit service. Our service analyzes publicly available information about your business including:

• Website technical health
• Google Business Profile completeness
• Business citation consistency across online directories
• Local search keyword rankings
• AI search visibility
• Competitor comparison

All audit data is sourced from publicly available information on the internet.

3. Our Services and Pricing

One-Time Audit — $79
A complete 7-module website visibility audit delivered as a branded PDF report. Includes website health, Google Business Profile analysis, citation audit, local rankings, AI visibility check, and competitor comparison.

Monthly Monitoring — $49/month
Everything in the one-time audit, re-run monthly. Includes score trend tracking and email alerts when scores drop.

Agency Plan — $199/month
Unlimited business audits with white-label branding for marketing agencies.

Prices are in USD. Taxes may apply depending on your location.

4. Payment Terms

• All payments are processed securely by Stripe
• One-time audits are charged at the time of purchase
• Monthly subscriptions are billed on a recurring basis on your billing date
• All sales are final — see our Refund Policy in Section 8

We do not store your payment card information. All payment data is handled by Stripe in accordance with PCI-DSS standards.

5. Delivery of Services

One-time audits: Delivered within 24 hours of payment confirmation. In most cases delivery is within 1-2 hours during business hours.

Monthly monitoring: Reports are generated and emailed on your monthly anniversary date.

If we are unable to generate your audit due to technical issues with your website or our systems, we will notify you within 24 hours and either resolve the issue or provide a full refund.

6. Accuracy of Audit Data

Our audits are based on publicly available data at the time the audit is run. We make no guarantees that:

• All citations or directory listings will be detected
• Search rankings shown reflect rankings in your specific location at all times
• Google Business Profile data is complete or current
• AI reputation scores reflect all available AI systems

Audit results represent a snapshot in time and may differ from what you see when searching manually due to personalization, location, and other factors Google applies to individual searches.

We are not responsible for decisions made based on audit results.

7. Appropriate Use

You agree not to use our service to:

• Audit businesses you do not own or have authorization to audit
• Resell audit reports without an Agency Plan subscription
• Attempt to reverse engineer, scrape, or copy our audit methodology
• Harass, spam, or contact businesses in a way that violates applicable law
• Violate any applicable local, state, or federal law

We reserve the right to suspend or terminate accounts that violate these terms.

8. Refund Policy

One-time audits: If your audit cannot be completed due to a technical issue on our end, you will receive a full refund. We do not offer refunds for completed audits.

Monthly subscriptions: You may cancel at any time. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial months.

9. Intellectual Property

Our content: The Prism Website Visibility Check platform, methodology, software, branding, and report designs are owned by CloudPlus Marketing. You may not copy, reproduce, or distribute our materials without written permission.

Your audit report: When you purchase an audit, you receive a license to use your report for your own business purposes. Agency Plan subscribers may use white-labeled reports for client deliverables.

Third-party data: Audit reports include data from Google, Yelp, and other third-party platforms. That data remains the property of the respective platforms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, or consequential damages
• We are not liable for lost profits, lost revenue, or lost business opportunities
• We are not liable for decisions you make based on audit results

Our service is provided "as is" without warranties of any kind, express or implied.

11. Indemnification

You agree to indemnify and hold harmless CloudPlus Marketing, its owners, and employees from any claims, damages, or expenses (including legal fees) arising from:

• Your use of our service
• Your violation of these Terms
• Your violation of any third-party rights

12. Privacy

Your use of our service is also governed by our Privacy Policy, available at cloudplusmarketing.com/privacy. By using our service, you agree to the collection and use of information as described in that policy.

13. Communications

By providing your email address, you consent to receive service-related communications including your audit report, account updates, and marketing communications. You may opt out of marketing communications at any time by replying STOP or clicking the unsubscribe link in any email.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Continued use of our service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York State.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CloudPlus Marketing regarding our service and supersede all prior agreements.
